By accessing and using the website located at bloomingtonconcretecontractor.com, or by requesting, scheduling, or receiving services from Bloomington Concrete Company, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our website or services. We reserve the right to update these terms at any time, and your continued use of the website or services following any changes constitutes your acceptance of the revised terms.
Bloomington Concrete Company provides concrete contracting services to residential and commercial customers in Bloomington, IL and surrounding areas. Services include, but are not limited to, concrete driveway building, patio construction, sidewalk building, garage floor installation, foundation work, stamped and decorative concrete, retaining walls, pool decks, steps, and concrete cutting.
All services are subject to a written scope of work and estimate agreed upon by both parties prior to commencement. We reserve the right to decline any project request at our sole discretion.
Estimates are provided at no charge and without obligation. All estimates are based on conditions observed at the time of the site visit. Final pricing is determined by a written contract or work order signed by both parties before work begins.
If site conditions discovered during the project materially differ from those present at the time of the estimate - such as unforeseen subsurface conditions, hidden obstructions, or access limitations - we will notify you before proceeding with any additional work and provide a written change order for your approval.
Verbal quotes are not binding. Only written, signed agreements constitute a commitment to perform work at a stated price.
Scheduling is subject to availability and weather conditions. Concrete work cannot be safely performed when temperatures are expected to drop below 40 degrees Fahrenheit within 24 hours of the pour, or during periods of heavy rain. We will notify you as soon as possible if a scheduled job must be postponed due to weather, and we will work with you to reschedule promptly.
If you need to cancel or reschedule a confirmed appointment, please notify us at least 48 hours in advance by phone or email. Cancellations within 48 hours of the scheduled start date may result in a cancellation fee, as materials and labor may have already been arranged for your project.
We reserve the right to cancel a project if site access is not made available as agreed, if payment terms are not honored, or if conditions exist that make safe or compliant work impossible.
Payment terms are specified in the written agreement for each project. For most residential projects, a deposit may be required before work begins, with the remaining balance due upon completion. Specific payment schedules for larger projects will be outlined in the contract.
Accepted payment methods will be communicated at the time of agreement. Final payment is due upon completion of the work and your acceptance of the finished project. Invoices not paid within the agreed timeframe may be subject to a late fee or interest as permitted under Illinois law.
If payment is disputed or withheld without written notice of a defect, we reserve all rights available under Illinois law, including the right to file a mechanics lien on the property where work was performed.
To the fullest extent permitted by applicable law, Bloomington Concrete Company's total liability to you for any claim arising out of or relating to our services or these terms will not exceed the total amount you paid us for the specific project giving rise to the claim.
We are not liable for indirect, incidental, consequential, special, or punitive damages, including loss of profits, loss of use, or damage to property not directly caused by our work, even if we have been advised of the possibility of such damages. This limitation applies to all causes of action, whether based in contract, tort, warranty, or otherwise.
We stand behind our work. Any warranty on workmanship or materials will be described in your written project agreement. Unless otherwise stated in writing, our workmanship warranty covers defects directly attributable to our installation methods or materials, but does not cover damage caused by normal wear, freeze-thaw cycles, use of ice melting chemicals, vehicle loads exceeding the specified design, tree root intrusion, or acts of nature.

If a dispute arises between you and Bloomington Concrete Company relating to our services or these terms, we ask that you first contact us directly to attempt to resolve the matter informally. Most concerns can be resolved quickly with a direct conversation.
If the dispute cannot be resolved informally within 30 days of written notice, both parties agree to submit the dispute to non-binding mediation before pursuing any legal action. Mediation will take place in McLean County, Illinois, unless both parties agree to a different location.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions. Any legal proceedings arising out of or relating to these terms or our services will be brought exclusively in the state or federal courts located in McLean County, Illinois, and you consent to the personal jurisdiction of those courts.
